Terms of Use and Sale

These Terms are an agreement between you and Curated Moments Co. LLC, doing business as Curated Moments Co. In these Terms, “Curated Moments” refers to Curated Moments Co. LLC. By using this website or placing an order, you agree to these Terms and the policies that apply to your purchase.

Who may place an order

You must be at least 18 years old, or the legal age to enter a contract where you live, to place an order. A parent or legal guardian must place an order for a person who does not meet this requirement.

Orders and acceptance

An online order is confirmed only after payment succeeds. Curated Moments may refuse, limit, pause, or cancel an order when:

Payment cannot be verified or fraud is suspected.
Customer-supplied content may violate copyright, privacy, safety, or other rights.
The requested content violates the content rules below.
A price, discount, product description, or checkout calculation contains an error.
Materials, equipment, or inventory become unavailable.
The requested production schedule cannot reasonably be met.
The customer does not provide required information or approval.
Fulfilling the order would violate applicable law or an event, venue, shipping, or service-provider requirement.

If Curated Moments cancels an order, we will notify you and refund any amount paid for the unfulfilled portion under the applicable Payments and Shipping and Returns policies.

Prices, payment, shipping, and returns

The Payments policy explains online payment, taxes, shipping charges, receipts, unsuccessful payments, and refunds. The Shipping and Returns policy explains processing, delivery, changes, cancellations, returns, damaged or incorrect products, and refund amounts. Those policies form part of these Terms.

Event, business, bulk, and Reveal Collection projects may use an individual proposal or agreement with separate pricing, scheduling, payment, cancellation, and delivery terms.

Customer photographs, artwork, and permissions

You retain ownership of the photographs, artwork, logos, names, messages, and other content you provide, subject to the rights of any original owner. You confirm that you own the content or have all permissions needed for Curated Moments to reproduce and use it to complete your order. Possessing a photograph or appearing in it does not necessarily give you the right to reproduce it.

You give Curated Moments and the service providers needed to complete your order limited permission to store, access, crop, resize, adjust, reproduce, print, transmit, package, deliver, and provide support for the submitted content solely for order creation and fulfillment. This permission does not transfer ownership and does not allow Curated Moments to use your content in advertising, social media, portfolios, or samples without separate consent. Storage and deletion follow the Privacy policy.

Content we will not produce

You may not submit material that:

Is unlawful or promotes illegal activity.
Infringes copyright, trademark, privacy, publicity, or other rights.
Is sexually explicit, exploitative, or depicts the sexualization or abuse of a minor. For these Terms, a minor is a person under 18 years old.
Is hateful, threatening, harassing, defamatory, discriminatory, or encourages violence.
Contains graphic violence or content intended to shock, intimidate, or harm.
Is fraudulent, deceptive, impersonates another person or organization, or misrepresents authorization.
Includes private or sensitive personal information without permission.
Uses a QR code, link, or other element for phishing, malware, fraud, or another unsafe destination.
Otherwise creates a reasonable legal, safety, or rights concern for Curated Moments.

Ordinary family photographs, including photographs of minors, are permitted when you have the necessary rights and the content does not violate these rules. Curated Moments makes the final production decision and may request proof of permission. If an order is refused before production, we will refund the unfulfilled amount under the applicable policies.

Approval of custom products

Before submitting an order, you are responsible for reviewing the selected format, crop, orientation, spelling, names, dates, messages, and other customization. Submitting the order confirms your approval of the displayed preview and order details.

Screen colors and a finished printed product may vary slightly because screens, photographs, materials, and printing processes differ. Image-quality and edge warnings are guidance, not a guarantee of the finished result. Curated Moments may contact you if we notice an obvious quality concern, but you remain responsible for the photograph and approved choices.

Customer-approved content is not a production error unless the delivered product differs from the approved preview or order details. Damage, defects, incorrect items, and production errors remain covered by the Shipping and Returns policy.

QR-connected products

You must provide or approve the exact QR destination before production and confirm that you are authorized to use it. The destination must comply with these Terms.

Curated Moments may test a QR code before production, but you remain responsible for reviewing and approving the destination. After delivery, you are responsible for maintaining the destination, domain, account, page permissions, and linked content. Curated Moments is not responsible when a link later changes, expires, becomes private, is removed, or becomes unavailable because of a third-party service, customer action, device, connectivity, or camera compatibility.

Curated Moments may refuse a destination that appears unsafe, deceptive, unlawful, or technically unsuitable. A QR code that fails because of a verified printing or production defect remains covered by the Shipping and Returns policy. If Curated Moments provides ongoing destination management under a separate service agreement, that agreement controls those responsibilities.

Curated Moments intellectual property

Curated Moments retains ownership of its original collections, product artwork, photographs, website copy, graphics, logos, branding, layouts, and other original materials. Purchasing a physical product gives you ownership of that physical item, but does not give you the right to reproduce, scan, copy, alter, distribute, manufacture, or resell the underlying artwork.

You may photograph purchased products for ordinary personal, gift, or social-media use, provided you do not claim ownership of the artwork or use it commercially. Business use, resale, licensing, reproduction, or production based on Curated Moments artwork requires prior written permission. Product photographs and enlarged images may be protected with watermarks and download restrictions.

Responsibility for third-party claims

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Curated Moments, its owner, employees, and necessary service providers from third-party claims arising from customer-supplied content, your lack of required permission, misuse of the website or products, or your violation of these Terms. Covered amounts include resulting damages, settlements, and reasonable legal fees and costs.

You must cooperate with the defense. Curated Moments may control the defense and settlement of a claim affecting the company. You may not agree to a settlement that admits fault by Curated Moments, requires Curated Moments to pay, or imposes an obligation on Curated Moments without written consent.

This section does not apply to the extent a claim is caused by Curated Moments’ gross negligence, willful misconduct, or use of customer content beyond the approved fulfillment purpose.

Website availability and product information

The website and online tools are provided on an “as available” basis. Curated Moments does not guarantee uninterrupted or error-free access. Product descriptions and images are presented as accurately as reasonably possible, but slight differences in color, scale, material, and screen-to-print appearance may occur.

To the fullest extent permitted by law, the express remedies in the Shipping and Returns policy replace other warranties. Curated Moments is not responsible for interruptions or failures caused by carriers, payment processors, hosting providers, customer devices, internet service, or other third parties outside our reasonable control.

Limitation of liability

To the fullest extent permitted by law, Curated Moments is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, business interruption, or lost data. Curated Moments’ total liability for a claim is limited to the amount paid for the affected order.

These limits do not apply where prohibited by law or to liability that cannot legally be limited, including liability for Curated Moments’ gross negligence or willful misconduct. Nothing in these Terms removes customer rights that cannot legally be waived.

Events outside our control

Curated Moments is not responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, wildfire, natural disaster, emergency, government action, carrier or supplier interruption, utility or internet outage, hosting or payment-processor interruption, labor disruption, material shortage, equipment failure that could not reasonably have been prevented, serious illness or medical emergency affecting essential production personnel, event cancellation, or venue restriction.

We will notify affected customers as soon as reasonably possible and provide a revised schedule. For an unshipped standard order, you may accept the revised date or receive the applicable refund under the Shipping and Returns policy. Individual project agreements may define additional rescheduling or cancellation terms.

Governing law and disputes

These Terms are governed by Arizona law, without applying conflict-of-law rules. Before filing a formal claim, you must send a written description to info@curatedmomentsco.com and allow 30 days for both sides to try to resolve it informally.

If a dispute cannot be resolved, it must be brought in an appropriate state or federal court serving Maricopa County, Arizona, unless applicable law requires another location. Either party may use an eligible small-claims court. Nothing prevents either party from seeking urgent court relief to protect intellectual property, confidential information, or safety.

An individual project agreement may include different dispute terms, which control for that project.

General provisions

These Terms, the Payments policy, Shipping and Returns policy, Privacy policy, order confirmation, and any applicable project agreement form the complete agreement for the purchase. If an individual event, business, bulk, or Reveal Collection agreement conflicts with these general Terms, the individual agreement controls for that project.

If one provision is found unenforceable, the remaining provisions continue. A delay in enforcing a provision does not waive the right to enforce it later. You may not transfer an order, agreement, or rights under these Terms without written permission. Curated Moments may transfer its rights and obligations as part of a business reorganization, sale, or transfer.

Provisions concerning payment, ownership, customer content, responsibility for third-party claims, liability, and disputes remain effective after an order is completed or cancelled. Electronic order confirmations, notices, and policy communications satisfy written-notice requirements where legally permitted.

Curated Moments may update these Terms by posting a revised date. Changes apply prospectively and do not alter an already accepted order unless required by law or agreed with the customer. Section headings are organizational only and do not change the meaning of these Terms.
